These Terms of Service (“Terms”) govern your use of the website thegreatwine.nl and any purchases made through our online store, operated by The Great Wine B.V.

2. Age Restriction — Minimum Age 18

IMPORTANT: In accordance with the Dutch Alcohol Act (Alcoholwet, formerly Drank- en Horecawet), the sale of alcoholic beverages to persons under the age of 18 is strictly prohibited. By placing an order on our website, you confirm that you are at least 18 years of age.

We are required by law to verify your age at the time of purchase and at the time of delivery. Our delivery partner may request a valid form of identification (passport, ID card, or driving licence) upon delivery. If the recipient cannot provide valid identification proving they are 18 or older, the delivery will not be completed.

3. Prices and Payment

All prices on our website are displayed in euros (€) and include Dutch VAT (BTW) at the applicable rate. Shipping costs are calculated and displayed separately during checkout before you confirm your order.

We accept the payment methods displayed during checkout. Payment is due at the time of placing your order. Your order will be processed after successful payment.

4. Formation of Contract

A binding purchase agreement is formed when you receive an order confirmation from us by email. We reserve the right to refuse or cancel an order in exceptional circumstances (e.g. pricing errors, stock unavailability, or failure to pass age verification).

5. Delivery

We aim to process and ship orders within 1–2 business days. Estimated delivery times are provided during checkout and are indicative only. We are not liable for delays caused by circumstances beyond our control (force majeure), including but not limited to carrier delays, natural disasters, or government actions.

Risk of loss and damage passes to you upon delivery. However, if a product arrives damaged, please refer to our Return & Refund Policy.

6. Right of Withdrawal

As a consumer purchasing from within the European Union, you have a 14-day right of withdrawal (herroepingsrecht) in accordance with EU Directive 2011/83/EU. For full details, please see our Return & Refund Policy.

7. Legal Guarantee of Conformity

Under EU consumer law, all products sold through our store are covered by a two-year legal guarantee of conformity. If a product does not conform to the sales contract, you are entitled to request repair, replacement, a price reduction, or a refund, in accordance with applicable law.

8. Intellectual Property

All content on this website, including but not limited to text, images, logos, and graphic design, is the property of The Great Wine B.V. and is protected by applicable intellectual property laws. You may not reproduce, distribute, or otherwise use any content from this website without our prior written consent.

9. Limitation of Liability

We are liable only for damages resulting from intent or gross negligence on our part. Our total liability for any claim shall not exceed the purchase price of the product(s) in question. This limitation does not apply to liability that cannot be excluded or limited under Dutch law (e.g. liability for personal injury or fraud).

10. Force Majeure

We are not liable for any failure to perform our obligations where such failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, transport strikes, or supply chain disruptions.

11. Privacy

We process personal data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

12. Complaints

If you have a complaint about a product or our service, please contact us at info@thegreatwine.nl. We will respond to your complaint within 14 days. Indien wij er samen niet uitkomen, kunt u uw klacht voorleggen aan De Geschillencommissie via www.degeschillencommissie.nl. De Geschillencommissie voor Consumentenzaken in Den Haag is de bevoegde instantie voor buitengerechtelijke geschillenbeslechting.

13. Applicable Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in the district of Oost-Brabant, the Netherlands. This choice of jurisdiction does not affect your rights as a consumer under mandatory consumer protection law of your country of residence.

14. Amendments

We reserve the right to amend these Terms at any time. Amended Terms will be published on this page with an updated revision date. The applicable Terms are those in effect at the time of your order.
